RELEASE OF LIABILITY, WAIVER OF CLAIMS, ACKNOWLEDGMENT OF RULES, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT

PLEASE READ CAREFULLY!

This document applies to all LWSC activities, including but not limited to Alpine skiing, Nordic skiing, snowshoeing, tubing, sledding, snowboarding, ski jumping, fat biking, using rental equipment, sledding, races, use of LWSC facilities, and attending or participating in instructional courses or special events (“LWSC Activities”). 

 

LWSC season pass holder(s) agree as follows: 
 

  1. In consideration of LWSC agreeing to permit my participation in LWSC Activities, I hereby RELEASE, HOLD HARMLESS AND INDEMNIFY THE LEAVENWORTH WINTER SPORTS CLUB, ITS DIRECTORS, SUBSIDIARIES, OFFICERS, EMPLOYEES, VOLUNTEERS AND AGENTS (collectively “Releasees”) from any and all claims and medical expenses for any loss, damage, expense or injury, including death, that I may suffer or that my next of kin may suffer, arising out of or in connection with the use of LWSC facilities and participating in LWSC Activities, including but not limited to claims alleging negligence. 
  2. I understand and agree that LWSC Activities have inherent risks and that dangers and hazards exist at LWSC facilities including but not limited to bare spots, variations in snow, ice, unpredictable terrain, bumps, moguls, stumps, forest growth, debris, rocks, wildlife including bears and cougars, inclement weather, streams, rivers, potential collisions with other users, fall risks, difficult driving and parking conditions, AND NEGLIGENCE OF THE RELEASEES, INCLUDING THE FAILURE BY THE RELEASEES TO SAFEGUARD OR PROTECT ME FROM THE RISKS, DANGERS AND HAZARDS REFERRED TO ABOVE. I am aware of and assume such risks and dangers of LWSC Activities whether marked or unmarked and freely accept and fully assume the possibility of personal injury, death, property damage or loss resulting therefrom.
  3. I have read, understand, agree with, and will obey LWSC’s rules and policies, as well as the Pacific Northwest Ski Area Association’s Your Responsibility Code and Smart Style. 
  4. I hereby agree to grant permission to the LWSC to utilize the pass holders’ image or likeness on photographs or videotapes for the LWSC’s promotion purposes. 
  5. This is a binding contract that is intended to provide a comprehensive release of liability, but it is not intended to assert any defenses that are prohibited by law. This contract shall be binding upon my heirs, next of kin, successors, assigns, executors, administrators, executors, and representatives. If any part of this contract is deemed unenforceable, all other parts shall be given full force and effect. 
  6. Any litigation involving the parties to this contract shall be brought solely in Chelan County, shall be within the exclusive jurisdiction of Chelan County and Washington State Law will apply.
  7. In entering this Agreement, I am not relying on any oral or written representations or statements made by the Releasees with respect to the safety of participating in LWSC Activities.
 
Membership Rules and Policy: 
  1. All season passes are non-transferable and non-refundable. There will be no refunds on season pass purchases, including the possibility of a season with limited or no operations due to low snowfall. 
  2. Season Pass Holders must display their season pass at all times when using LWSC facilities. 
  3. Lost or stolen passes must be reported to a ticket booth as soon as possible. 
  4. The LWSC reserves the right to change its tentative open/close dates and operating hours, as well as determine the number of lifts in operation and terrain available to use at any given time. 
  5. The LWSC reserves the right to cancel a season pass for failure to comply with regulations set herein and/or disregard for the safe use of lifts, terrain, and/or other facilities, disregard of LWSC rules and policies, or failure to adhere to the Pacific Northwest Ski Area Association’s Your Responsibility Code and Smart Style. This includes, but is not limited to, criminal misconduct, disruption of business, reckless or excessive speed, skiing/riding outside the ski area boundary and violation of laws or policies of the Wenatchee National Forest, US Fish and Wildlife Service, City of Leavenworth, Leavenworth Golf Course, and the Peshastin-Mill Site.
